Therefore, there is a need for an effective, flexible, and confidential dispute resolution mechanism. In this context, commercial arbitration is considered an appropriate method because it allows the selection of arbitrators with specialized expertise, ensures confidentiality, and effectively meets the specific characteristics of information technology disputes.<\/span><\/p>\n<h2><b>I. Overview of Commercial Arbitration and Information Technology<\/b><\/h2>\n<h3><b>1. Commercial Arbitration<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Article 3 of the Law on Commercial Arbitration 2010 provides that:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cCommercial arbitration is a method of dispute resolution agreed upon by the parties and conducted in accordance with the provisions of this Law.\u201d<\/span><\/p>\n<h3><b>2. Information Technology (IT)<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Information technology is the field that uses computer systems, software, and networks to store, process, transmit, and protect information. In the context of digital transformation and the rapid development of the digital economy, disputes arising in the field of information technology are increasing and becoming more technically complex.<\/span><\/p>\n<h2><b>II. Common Types of Disputes in Information Technology<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">IT disputes commonly arise from the following situations:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">First, <\/span><b>software development contract disputes<\/b><span style=\"font-weight: 400;\">. These disputes arise when one party hires another to design, develop, or upgrade software according to specific requirements. Therefore, it is increasingly chosen by technology companies as a suitable mechanism for resolving business disputes.<\/span><\/p>\n<h2><b>IV. Notes on Drafting Arbitration Clauses in Technology Contracts<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Not only in technology contracts but in any contract intended to resolve disputes through arbitration, the arbitration clause must be drafted clearly and comprehensively to ensure effective dispute resolution.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">First, the parties should clearly specify the <\/span><b>arbitration institution<\/b><span style=\"font-weight: 400;\"> that will have jurisdiction to resolve disputes. This is particularly important for technology contracts involving foreign elements, where parties may come from different countries and use different languages. Determining the applicable law helps clarify the parties\u2019 rights and obligations and assists the arbitral tribunal in making its decision.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Finally, arbitration clauses should be <\/span><b>clear, complete, and consistent<\/b><span style=\"font-weight: 400;\"> to avoid different interpretations. As technology-related transactions increase in both number and scale, contractual relationships in the information technology sector have become more diverse and complex.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Along with this development, technology-related disputes are also increasing and becoming more complicated. These disputes often involve technical issues, intellectual property rights, data, information security, or technology contracts with foreign elements. This situation requires a dispute resolution mechanism that ensures both expertise and flexibility while responding quickly to the needs of the digital business environment.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">With advantages such as flexible procedures, faster resolution, the ability to appoint specialized arbitrators, and strong confidentiality protection, commercial arbitration helps businesses resolve disputes effectively while minimizing negative impacts on business operations and corporate reputation in the digital economy.<\/span><\/p>\n<h2><b>VI. Conclusion<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">In a context where information technology is closely integrated into daily life, technology-based business activities are expanding and playing an increasingly important role in the economy. As technology continues to develop, disputes related to technology contracts, intellectual property rights, data, and information security are also increasing.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Given the complex nature of disputes in the information technology sector, commercial arbitration is considered a suitable dispute resolution method due to its flexibility, efficiency, and ability to ensure confidentiality. Therefore, technology companies should proactively include clear arbitration clauses in their contracts from the outset in order to protect their rights and minimize legal risks when disputes arise.<\/span><\/p>\n<h2><b>VII. How to Resolve Disputes through the BigBoss International Commercial Arbitration Center<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">To resolve disputes through arbitration at BBIAC, customers may include one of the following clauses in their contracts:<\/span><\/p>\n<h3><b>1.
