TOTAL VALUE IN DISPUTE
SCHEDULE OF MEDIATION FEES
1. Mediation registration fee and mediation fee
1.1. The mediation registration fee is 3,000,000 VND.
1.2. The conciliation fee (excluding the conciliation registration fee) is calculated on the basis of the value of the dispute which is the total value of all claims of the parties in the dispute.
1.2.1. In case the dispute is resolved by 01 to 03 Mediators

1.2.2. The center’s chairman decides on the mediation fee based on the number of mediators conducting the mediation, the value of the dispute, the complexity of the dispute and the time to resolve the dispute in the following cases. :
The dispute was resolved by more than 03 mediators;
The dispute is resolved by a foreign mediator;
The parties did not specifically state the value of the dispute; or
The parties adjust the value of the dispute to increase or decrease during the mediation process.
1.2.3. The parties can propose to the Center an agreement to apply a mediation fee different from the mediation fee stated in section 1.2.1.
1.3. The value of the dispute in foreign currency is converted to Vietnamese Dong according to the transfer rate of the Joint Stock Commercial Bank for Foreign Trade of Vietnam (Vietcombank) on the date of submission of the Request for Conciliation.
1.4. If the parties do not agree otherwise, the fees stated in section 1.2.1, section 1.2.2 and section 1.2.3 are divided equally between the parties.
1.5. The settlement fee is inclusive of VAT.
Refund of arbitration fees
2. Cases where conciliation fees are refunded (excluding conciliation registration fees)
2.1. In case the party requested for mediation refuses to conciliate or does not send a reply to the Center as prescribed in Item d) Clause 1 Article 16 of the Mediation Rules of BIGBOSS INTERNATIONAL, BIGBOSS INTERNATIONAL will refund the entire mediation fee. (excluding the mediation registration fee) that the party requesting mediation has paid to BIGBOSS INTERNATIONAL;
2.2. In case one party or parties declares that they want to terminate the mediation according to item c) clause 1 Article 16 of the Mediation Rules of BIGBOSS INTERNATIONAL after the time the appointed Mediator has accepted the appointment, the Center will refund 80% mediation fee (not including mediation registration fee);
2.3. In case one party or the parties declares that they want to terminate the mediation in accordance with Item c) Clause 1 Article 16 of the Mediation Rules of BIGBOSS INTERNATIONAL after BIGBOSS INTERNATIONAL has notified of the opening date of the first mediation session but before the date of the first mediation session. For this first mediation, the Center will refund 60% of the mediation fee (excluding the mediation registration fee);
2.4. In case BIGBOSS INTERNATIONAL mediation is terminated according to Item b) Clause 1 Article 16 of the Mediation Rules of BIGBOSS INTERNATIONAL, BIGBOSS INTERNATIONAL will refund the fees respectively according to the cases specified in Section 2.2 and Section 2.3 of this Fee Schedule.
